Mediation should be ‘first port of call’ in civil disputes, says High Court president

As highlighted in recent commentary from the High Court President, there is a growing recognition that mediation should be the first port of call in civil disputes, offering a more efficient, cost-effective, and collaborative route to resolution than traditional litigation.

From a learning and development perspective, this shift underscores a critical skills gap across organisations: the ability to manage conflict constructively, facilitate dialogue, and reach sustainable outcomes. Mediation is no longer a specialist capability, it is becoming a core professional competency.

At Positive2Work Skillnet, we are actively responding to this need through our ESF+ funded Mediation Skills Programme. Currently midway through our first cohort of 2026, we are already seeing strong engagement from participants across sectors who are keen to embed practical mediation techniques into their day-to-day roles.

Building on this momentum, our second programme will launch this September, offering further opportunities for professionals to develop these essential skills in a structured, supportive environment.
